STATE OF LOUISIANA v. JUNIOR WESTON


In Re: Junior Weston, applying for supervisory writs, 16th Judicial District Court, Parish of St. Mary, No. 13-189923. BEFORE: GUIDRY, WELCH, AND THERIOT, JJ.

WRIT DENIED. We have been advised by the St. Mary Parish Clerk of Court's Office that the district court is proceeding toward disposition of relator's Motion to Withdraw Guilty Plea and Supplemental Motion to Withdraw Guilty Plea. Further, the Clerk of Court has no record of receiving a "Notice to the Court" (allegedly filed December 16, 2014) or a "Motion for Evidentiary Hearing and Motion for Appointment of Counsel" (allegedly filed on December 20, 2014). Relator should file these motions with the clerk of court of the district court before seeking relief from this Court.
