STATE OF LOUISIANA v. WYATT WATTS


In Re: State of Louisiana, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 05-13-0382. BEFORE: PETTIGREW, HIGGINBOTHAM AND CRAIN, JJ.

WRIT GRANTED. The record before this Court does not reflect that the victim had an opportunity to state her privacy interest in her medical records. Thus, the writ application is granted for the sole purpose of remanding the matter to the district court to provide the victim with an opportunity to state her privacy interest in her medical records. See La. R.S. 13:3715.1(B)(5); see also State v. Boudreaux, 2013-2732 (La. 1/17/14), 132 So.3d 381 (per curiam).
