The STATE of Texas, Appellant v. Kyle Tyrone WARNER, Appellee

From the County Court, Bexar County, Texas

Trial Court No. 390617

The Honorable Michael La Hood, Judge Presiding

ORDER

Appellee has filed an objection to the State's designation of a DVD for inclusion in the appellate record. Appellee contends the trial court's findings of fact and conclusions of law establish the DVD in question was never offered into evidence at the suppression hearing. We DENY appellee's motion, but advise the parties that pursuant to established law, this court in its review will consider only that evidence that was properly before the trial court.
