STATE OF LOUISIANA v. RODNEY D. WAGLEY


Rodney D. Wagley, applying for supervisory writs, 32nd Judicial District Court, Parish of Terrebonne, No. 831,167.

BEFORE: GUIDRY, MCDONALD, AND WOLFE, JJ.

WRIT GRANTED. Relator's conviction of criminal trespassing is reversed, his sentence is vacated, and relator is discharged. Viewing the evidence in the light most favorable to the prosecution and based on the unique facts and circumstances of this case, we find that all of the elements of criminal trespass were not proven beyond a reasonable doubt.
