Opinion

Case No. 4D99-4039

Opinion filed October 4, 2000

Appeal from the Circuit Court for the Nineteenth Judicial Circuit, Martin County; David Harper, Judge; L.T. Case No. 99-4537 MMA.

Robert A. Butterworth, Attorney General, Tallahassee and Robert R. Wheeler, Assistant Attorney General, West Palm Beach, for appellant.

Diamond R. Litty, Public Defender, Stuart, and Andrew Shultz, Assistant Public Defender, Stuart, for appellee.

We reverse the order granting Veltre's motion to dismiss and answer the certified question in the negative. Section 827.04(1)(a) is not unconstitutionally vague. See State v. Fuchs, No. SC96766, 2000 WL 1288872 (Fla. Sept. 14, 2000).

DELL and SHAHOOD, JJ., concur.
