Before this Court are appellee's December 21, 2023 motions to supplement the record and for an extension of time to file his brief, and his December 29, 2023 motion to remand this case to the trial court. We GRANT appellee's December 21, 2023 motions and ORDER the County Clerk for Dallas County to file, within FIFTEEN DAYS of the date of this order, a supplemental clerk's record containing Defendant's Brief in support of Motion for New Trial and Motion in Arrest of Judgment.
In the event the County Clerk for Dallas County does not have in its possession Defendant's Brief in support of Motion for New Trial and Motion in Arrest of Judgment, we ORDER the County Clerk for Dallas County to file, within FIFTEEN DAYS of the date of this order, a letter verifying that the clerk does not have possession of this document.
Appellee's brief is due THIRTY DAYS after the County Clerk files the supplemental record or a letter verifying that the Clerk does not have possession of Defendant's Brief in support of Motion for New Trial and Motion in Arrest of Judgment.
We DENY appellee's December 29, 2023 motion to remand this case to the trial court.
We DIRECT the Clerk to send copies of this order, by electronic transmission, to the Honorable Angela King, Presiding Judge County Criminal Court No. 6, John F. Warren, County Clerk for Dallas County, and to counsel for all parties.
