On Appeal from the County Criminal Court No. 6 Dallas County, Texas Trial Court Cause No. M-22-10331
ORDER
ROBERT D. BURNS, III CHIEF JUSTICE
We REINSTATE this appeal.
The district clerk filed the clerk's record on August 8, 2023. On September 13, 2023, we ordered the trial court to make certain findings of facts related to appellee's motion for new trial. Further, we ordered the trial court to hold a hearing regarding a lost exhibit. Finally, we ordered the trial court to submit the findings to this Court and ordered the court reporter to file a supplemental record containing a transcription of the exhibit hearing.
On October 20, 2023, we received the trial court's supplemental record. The record, however, failed to include a transcript of a hearing related to the lost exhibit. Consequently, this Court issued an order on October 25, 2023, ordering the trial court to conduct a hearing regarding the lost exhibit and to file a supplemental record containing a transcript of the hearing. On the same day, October 25, 2023, the trial court filed a record containing the transcript of the hearing addressing the missing exhibit.
Accordingly, we VACATE our order of October 25, 2023, without prejudice to the appellant requesting supplementation of the appellate record with specific documents.
Appellant's brief is due DECEMBER 4, 2023.
We DIRECT the Clerk to send copies of this order to the Honorable Angela King, Presiding Judge, County Criminal Court No. 6; Sharon Rodriguez, Court Reporter; John F. Warren, Dallas County Clerk; Christina O'Neil, Chief Judicial Staff Counsel Criminal District Courts; and counsel for all parties
