State v. Valdes

Supreme Court of Florida
Oct 24, 2002
831 So. 2d 162 (Fla. 2002)

Opinion

No. SC01-1735.

Opinion filed October 24, 2002.

Application for Review of the Decision of the District Court of Appeal — Statutory Validity Third District — Case No. 3D00-1469, (Monroe County).

Robert A. Butterworth, Attorney General, Michael J. Neimand, Bureau Chief, and Paulette R. Taylor, Assistant Attorney General, Miami, Florida, for Petitioner.

Howard Brodsky, Miami, Florida, for Respondents.

We initially accepted jurisdiction to review State v. Valdes, 788 So.2d 300 (Fla. 3d DCA 2001), a decision of a district court of appeal that expressly declares a state statute valid. Upon reflection and further consideration, we now conclude that review was improvidently granted. Accordingly, this review proceeding is dismissed.

It is so ordered.

ANSTEAD, C.J., SHAW, WELLS, PARIENTE, LEWIS, and QUINCE, JJ., and HARDING, Senior Justice, concur.

NO MOTION FOR REHEARING WILL BE ALLOWED.
