ACOBA, J.[fn1] [fn1] The Honorable Mario R. Ramil, who joined the concurrence, has resigned his position effective December 30, 2002.

The concurring opinion of Acoba, J., filed with the majority opinion on December 26, 2002, is amended by deleting footnote 15 on page 20 and renumbering the successive footnotes accordingly.

The Clerk of the Court is directed to incorporate the foregoing change in the original opinion and take all necessary steps to notify the publishing agencies of these changes.
