1. On page 35, the subheading immediately following the first paragraph is renumbered “4” instead of “2.” That part is therefore part II.D.4.

2. On page 1, the publication order in footnote * is modified to read as follows: “Pursuant to California Rules of Court, rules 8.1105(b) and 8.1110, this opinion is certified for publication with the exception of parts II.A-C, II.D.1, II.D.3, and II.D.4.”

Except for this modification, the opinion remains unchanged. This modification does not effect a change in judgment.
