THE STATE OF TEXAS, Appellant v. LOUIS TURRUBIARTES, Appellee

From the County Court at Law No. 2 Brazos County, Texas Trial Court No. 22-01558-CRM-CCL2

Before Chief Justice Gray, Justice Johnson, and Justice Smith

SECOND ABATEMENT ORDER

PER CURIAM

On January 24, 2024, we issued an Abatement Order in this appeal. In the order, we abated this appeal and remanded this cause to the trial court. We ordered the trial court to, within 21 days of the date of the order, proceed as necessary to facilitate Appellee Louis Turrubiartes's access to the court recorder's record.

On January 30, 2024, Turrubiartes filed an unopposed motion to extend time in which to have an abatement hearing. We reinstate this appeal to issue this order.

Turrubiartes's Motion to Extend Time for Abatement Hearing, filed on January 30, 2024, is granted. We again abate this appeal and remand this cause to the trial court to comply with this Court's January 24, 2024 Abatement Order. However, the deadline for the trial court to proceed as necessary to facilitate Turrubiartes's access to the court recorder's record is extended to February 23, 2024. Similarly, the deadline for Turrubiartes to advise this Court, in writing, whether he has obtained access to the court recorder's record is extended to March 1, 2024.

Motion granted.
