STATE OF LOUISIANA v. JESSE TURNER


In Re: Jesse Turner, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 12-14-0670. BEFORE: WHIPPLE, C.J., McCLENDON AND HIGGINBOTHAM, JJ.

WRIT DENIED AS MOOT. The records of the East Baton Rouge Parish Clerk's Office reflect that the State filed a bill of information on December 17, 2014, within sixty days of relator's arrest, charging him as a principal to two counts of distribution of Synthetic Cannabinoid and possession of a firearm while in possession of a controlled dangerous substance, cocaine. Accordingly, relator's petition for a writ of habeas corpus wherein he seeks release under La. Code Crim. P. art. 701(B) was filed prematurely and is meritless and moot. See State v. Varmall, 539 So.2d 45 (La. 1989) (per curiam).
