STATE of Missouri, Respondent, v. Andre M. TURNER, Appellant.

Christian Lehmberg, Columbia for appellant. Dora Fichter, Jefferson City for respondent.

Christian Lehmberg, Columbia for appellant.

Dora Fichter, Jefferson City for respondent.

Before Division One: Cynthia L. Martin, P.J., and Victor C. Howard and Alok Ahuja, JJ.

ORDER

PER CURIAM:

Following a jury trial in the Circuit Court of Lafayette County, Andre Turner was convicted of second-degree assault of a law enforcement officer; second-degree assault; armed criminal action; resisting a lawful stop; and leaving the scene of a motor vehicle accident. Turner’s convictions arise from an incident in Odessa on February 5, 2016, in which he fled in his motor vehicle from a Missouri State Highway Patrol vehicle which was attempting to effect a traffic stop. Turner was sentenced to a total term of twenty years' imprisonment. He appeals. On appeal, Turner challenges only his second-degree assault conviction. He argues that the evidence was insufficient to prove that he attempted to cause physical injury to the passenger in the Highway Patrol vehicle (which he struck with his vehicle), because the State failed to prove that he was aware of the passenger’s presence in the vehicle. We affirm. Because a published opinion would have no precedential value, we have provided an unpublished memorandum to the parties which sets forth the reasons for this order. Rule 30.25(b).
