STATE OF LOUISIANA v. WILBERT THIBODEAUX

In Re: Wilbert Thibodeaux, applying for supervisory writs, 16th Judicial District Court, Parish of St. Mary, No. 2014-190149. BEFORE: GUIDRY, PETTTIGREW AND CRAIN, JJ.

WRIT GRANTED. The portion of the district court's ruling in which the court retained jurisdiction over relator's case and committed him to East Feliciana Forensic Hospital is vacated and the district court is ordered to strictly comply with the procedure outlined in La. Code Crim. P. art. 648(B)(3).

Pettigrew, J., dissents and would deny the writ application. In my opinion, Louisiana Code of Criminal Procedure article 648(B)(3) is fatally flawed. COURT OF APPEAL, FIRST CIRCUIT /s/_________
