Opinion

No. SC08-527.

November 10, 2008.

Lower Tribunal No(s). 2D05-3424.

Upon review of petitioner's response to this Court's order to show cause dated July 15, 2008, the Court has determined that it should decline to exercise jurisdiction in this case. See State v. Gibson, 985 So. 2d 1088 (Fla. 2008). The petition for discretionary review is, therefore, denied.

No motion for rehearing will be entertained by the Court. See Fla.R.App.P. 9.330(d).

WELLS, ANSTEAD, PARIENTE, LEWIS, and POLSTON, JJ., concur.
