STATE OF LOUISIANA v. MATTHEW JAMES SWAN


In Re: Matthew James Swan, applying for supervisory writs, 22nd Judicial District Court, Parish of St. Tammany, No. 575674. BEFORE: WHIPPLE, C.J., GUIDRY AND McCLENDON, JJ.

WRIT GRANTED WITH ORDER. There is no evidence in the record that this was a joint motion for continuance. Therefore, the district court abused its discretion and erred by characterizing it as such. Accordingly, the matter is remanded to the district court with instructions to amend the December 16, 2016 minute entry to reflect that the continuance was granted solely on motion of the State.
