Supreme Court of Louisiana
Sep 4, 1990
565 So. 2d 922 (La. 1990)

Opinion

No. 90-KD-1951.

September 4, 1990.

In Re: Sullivan, John L.; — Defendant; Applying for supervisory and/or Remedial Writs; Parish of Orleans Criminal District Court, Div. "G", Number 276-394.

Granted. The district court is ordered to permit Steve Ehrsam, Lera Trekell, Theresa Ehrsam, and Michelle Melle to testify. The testimony may be relevant for defendant to show how he would have used the undisclosed evidence in order to show that the result of the trial would have been different. United States v. Bagley, 473 U.S. 667, 105 S.Ct. 3375, 87 L.Ed.2d 481 (1985).

COLE, J., concurs, the majority is not ruling on the admissibility of the evidence.
