Zena Collins Stephens has filed a motion to consolidate these two appeals. The State opposes this motion. Cause number 01-19-00209-CV is the State's appeal from the trial court's order granting in part a motion to quash the indictment. Cause number 01-19-00243-CR is an appeal by Zena Collins Stephens from the denial of her petition for writ of habeas corpus. Stephens contends that consolidation is appropriate because many issues in the two cases overlap and consolidation would promote justice and judicial efficiency.
The Court grants the motion to consolidate only to the extent that the two causes will be submitted and determined together. Although no reporter's record has been filed in cause number 01-19-00243-CR, the Court will consider the reporter's record filed in 01-19-00209-CR in reviewing both appeals.
