Appeal from an order of the Supreme Court at Special Term, entered August 8, 1977 in Albany County, which denied defendant's motion to dismiss the complaint. Order affirmed, without costs, on the opinion of Pennock, J., at Special Term. Greenblott, J.P., Sweeney, Staley, Jr., Larkin and Mikoll, JJ., concur.
