The Sixth Amendment to the United States Constitution guarantees the right to a jury trial. State v. Steele, 134 Wn.App. 844, 850, 142 P.3d 649 (2006). This right extends to any fact that increases the penalty for a crime beyond the prescribed statutory maximum.
