STATE OF LOUISIANA v. JAMES J. SPIKES, JR.


In Re: James J. Spikes, Jr., applying for supervisory writs, 22nd Judicial District Court, Parish of Washington, No. 15-CR4-127264. BEFORE: HIGGINBOTHAM, THERIOT AND CHUTZ, JJ.

WRIT DENIED. The district court record reflects that on June 21, 2016, relator was re-arraigned on the underlying charges and, following a preliminary hearing, the district court found probable cause for these charges. Thus, the request for mandamus relief regarding the motion for preliminary examination and arraignment is moot. Furthermore, relator alleges he filed the request for mandamus relief regarding his motion for change of venue only seven days after he filed a motion in the court below. This Court will not intervene in a proceeding where the applicant has not allowed sufficient time for the district court to respond.
