STATE of Louisiana v. Deshawn SIMS

ON SUPERVISORY WRIT TO THE CRIMINAL DISTRICT COURT, PARISH OF ORLEANS

PER CURIAM

Writ granted. In light of the outstanding warrant for his parole violation, defendant had a diminished expectation of privacy. State v. Malone, 403 So.2d 1234 (La. 1981). Under the totality of circumstances, the State has met its burden of proving that the search of the vehicle was valid, and the evidence obtained should not have been suppressed. Accordingly, the trial court's ruling suppressing the evidence is reversed, and the case is remanded for further proceedings in accordance with this ruling.

JOHNSON, C.J., would deny.

GENOVESE, J., would deny.
