THE STATE v. TONY SHROPSHIRE


The Honorable Supreme Court met pursuant to adjournment. The following order was passed:

Court of Appeals Case No. A22A0838

The Supreme Court today granted the writ of certiorari in this case as case No. S23G0310.

This case will be assigned to the October 2023 oral argument calendar automatically under Supreme Court Rule 50 (1) (a). Oral argument is mandatory in granted certiorari cases.

This Court is particularly concerned with the following issue or issues:

Should a unit-of-prosecution analysis, as opposed to a required-evidence analysis, be applied to evaluate whether child molestation merges into aggravated child molestation? See generally Scott v. State, 306 Ga. 507 (832 S.E.2d 426) (2019); Drinkard v. Walker, 281 Ga. 211 (636 S.E.2d 530) (2006).

Briefs should be submitted only on these points. See Supreme Court Rule 45.
