Opinion

No. F-10-007.

Decided: October 22, 2010.

Trial Court No. 09CRB00437W.

Eric K. Nagel, Wauseon City Prosecutor, for appellee.

Clayton M. Gerbitz, for appellant.

DECISION AND JUDGMENT

{¶ 1} This is a companion case to State v. Sheffer, 6th Dist. No. F-10-005, 2010-Ohio-___. Appellant is Steven D. Sheffer, husband of Taryn Sheffer, appellant in the other action. The facts of this matter are more fully developed in the companion case.

{¶ 2} Both Steven and Taryn Sheffer were charged with and convicted of misdemeanor drug paraphernalia possession, following police entry into their home. Both unsuccessfully moved to suppress the evidence seized during that entry. In the companion case, we affirmed the propriety of the warrantless search.

{¶ 3} On authority of State v. Sheffer, 6th Dist. No. F-10-005, 2010-Ohio-, appellant's sole assignment of error is found not well-taken, and the judgment in the present matter is affirmed. Appellant is ordered to pay court costs of this appeal pursuant to App. R. 24.

JUDGMENT AFFIRMED.

A certified copy of this entry shall constitute the mandate pursuant to App. R. 27. See, also, 6th Dist. Loc. App. R. 4.

Peter M. Handwork, J., Arlene Singer, J., Thomas J. Osowik, P.J. CONCUR.
