STATE OF LOUISIANA v. MALIK SHABAZZ


In Re: Malik Shabazz, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge,

BEFORE: KUHN, HIGGINBOTHAM AND THERIOT, JJ.

WRIT GRANTED IN PART AND DENIED IN PART. The district court's ruling denying relator's pro se motion for appeal is reversed, and this matter is remanded to the district court with an order to reinstate relator's appeal rights. The documentation in the writ application supports that relator timely filed the motion for appeal. The district court's computer records reflect that the motion for appeal was filed on June 13, 2013, within thirty days of the district court's ruling denying the motion to reconsider sentence, filed on May 17, 2013, and the motion to reconsider sentence was filed on April 10, 2013, within thirty days of the imposition of relator's sentence on March 18, 2013. See La. Code Crim. P. art. 914(B)(2); see also La. Code Crim. art. 881.1(A)(1). In all other respects, the writ application is denied.
