STATE OF LOUISIANA v. TORRANCE SCOTT


In Re: Torrance Scott, applying for supervisory writs, 22nd Judicial District Court, Parish of Washington, Nos. 02-CR-84040 & 06-CR-94223. BEFORE: WHIPPLE, C.J., WELCH AND DRAKE, JJ.

WRIT DENIED. A pleading's nature is determined by its substance and not its caption. See State ex rel. Daley v. State, 97-2612 (La. 11/7/97), 703 So.2d 32. Relator's convictions and sentences became final more than seven years ago. Therefore, the writ of habeas corpus is an untimely application for postconviction relief, and relator failed to allege any exceptions to the time limitation. See La. Code Crim. P. art. 930.8(A).
