On appeal from the 25th District Court of Gonzales County, Texas.
ORDER FOR SUPPLEMENTAL BRIEFING
Before Chief Justice Valdez and Justices Benavides and Hinojosa
Order Per Curiam
This case is on remand from the Texas Court of Criminal Appeals. The court of criminal appeals vacated this Court's previous opinion and judgment, see State v. Ruiz, 509 S.W.3d 451, 452 (Tex. App.—Corpus Christi 2015), reversed and remanded, No. PD-1362-15, 2017 WL 430291 (Tex. Crim. App. 2017), and asked this Court to re-analyze the issue of exigent circumstances in light of two cases that were decided while Ruiz remained pending at the court of criminal appeals. See id. These cases are: Cole v. State, 490 S.W.3d 918 (Tex. Crim. App. 2016) and Weems v. State, 493 S.W.3d 574 (Tex. Crim. App. 2016).
On February 17, 2017, the State filed a motion for leave to file supplemental briefing in light of the court of criminal appeals' decision, which we granted. As a result, this Court hereby requests supplemental briefing from Ruiz on the same issue. See TEX. R. APP. P. 38.7 ("A brief may be amended or supplemented whenever justice requires, on whatever terms the court may prescribe."); see also id. R. 38.1(i) ("The brief must contain a clear and concise argument for the contentions made, with appropriate citations to authorities and to the record."). Ruiz's supplemental brief shall be filed within thirty days from the date of this order.
IT IS SO ORDERED.
PER CURIAM Order delivered and filed the 24th day of April, 2016.
