STATE OF MONTANA, Plaintiff and Appellee, v. DUSTIN JAMES ROUNSVILLE, Defendant and Appellant.

ORDER

Mike McGrath Chief Justice.

On July 7, 2022, this Court filed an Order stating Appellant Dustin James Rounsville's opening brief was overdue and ordered him to file the opening brief by July 27, 2022, or his appeal would be dismissed.

It has come to the Court's attention that due to a clerical error within the Clerk of Court's office, the due date for Appellant's opening brief was incorrectly entered into our case management system as June 26, 2022, rather than July 26, 2022.

THEREFORE, IT IS ORDERED that the July 7, 2022 Order is RESCINDED, and the May 20, 2022 Order granting Appellant until July 26, 2022, within which to file his opening brief stands.

The Clerk is directed to provide a copy of this Order to all counsel of record.
