STATE OF LOUISIANA v. EDRIS RANGE


In Re: Edris Range, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 10-13-0054. BEFORE: PETTIGREW, HIGGINBOTHAM AND CRAIN, JJ.

WRIT NOT CONSIDERED. Relator failed to comply with the return date requirements of Uniform Rules of Louisiana Courts of Appeal, Rules 4-3 and 4-5(C)(11), by failing to timely file the writ application. The return date order required the application to be filed in this Court on or before November 25, 2015. This writ application, filed on November 30, 2015, appears to be untimely, and there is no documentation of a timely request for an extension of the original return date. Relator's affidavit does not appear to be properly notarized. The notary failed to include her notary identification number, or her Louisiana state bar roll number. See La. R.S. 35:12(A) & (B). Relator failed to comply with Rule 4-5(C)(8) and (9), by failing to include a copy of the bill of information and any opposition or a statement that no opposing written document was filed. Relator also failed to comply with the page numbering requirements of Rule 4-5(B). Supplementation of this writ application and/or an application for rehearing will not be considered. See Uniform Rules of Louisiana Courts of Appeal, Rules 2-18.7 & 4-9. Because the trial in this case is scheduled for March 22, 2016, in the event relator elects to file a new application with this Court, the application shall be delivered to this Court on or before February 11, 2016, and the application should include documentation of an extension of the return date, correct the deficiencies herein, and comply with the requirements of Rule 4-4, concerning requests for expedited consideration. See also Rule 4-5(C)(12) & (D). Any future filing on this issue should include the entire contents of this application, the missing items noted above, and a copy of this ruling.
