Appeal from Criminal District Court No. 1 of El Paso County, Texas (TC # 20120D01012) ORDER
The clerk's record and reporter's record were not returned to this Court following issuance of the Court of Criminal Appeals' mandate and all efforts to locate the appellate record have been unsuccessful. The Court has obtained from the El Paso County District Clerk a file-marked copy of the clerk's record showing it was received in this Court on October 9, 2012. Our records reflect that the clerk's record was filed in this Court on that same date. Additionally, the District Clerk has provided the Court with a file-marked copy of the court reporter's record filed with the El Paso County District Clerk on August 29, 2012. Our record reflects that the court reporter's record was received in this Court on that same date, but it was not filed until October 9, 2012 when the clerk's record was filed. It is ordered that the Clerk of the Court file the copies to serve as the official clerk's record and reporter's record in this appeal.
