Opinion

No. 66535-9-I

10-24-2011

STATE OF WASHINGTON, Respondent, v. SLAVIK POTAPCHUK, Appellant.

UNPUBLISHED OPINION

Per Curiam. Slavik Potapchuk appeals an order of restitution entered following his conviction for first degree rendering criminal assistance. He contends, and the State concedes, that the trial court erred in ordering restitution for damage occurring before he rendered criminal assistance. See State v. Woods, 90 Wn. App. 904, 909, 953 P.2d 834 (1998) ("if the loss or damage occurs before the act constituting the crime, there is no causal connection between the two."). We accept the State's concession, reverse the order of restitution, and remand for adjustment of the restitution amount consistent with this opinion.

Reversed and remanded for further proceedings.
