Supreme Court of North Dakota
Dec 19, 2003
2003 N.D. 192 (N.D. 2003)

Opinion

No. 20030125

Filed December 19, 2003

Appeal from the District Court of McKenzie County, Northwest Judicial District, the Honorable David W. Nelson, Judge.

AFFIRMED.

Ross L. Sundeen, Assistant State's Attorney, 109 Fifth Street SW, P.O. Box 1260, Watford City, N.D. 58854-1260, for plaintiff and appellee; submitted on brief.

Steve Parizek, pro se, 2521 Circle Drive, Jamestown, N.D. 58401, defendant and appellant; submitted on brief.

[¶ 1] Steve Parizek appeals from a Northwest Judicial District Court judgment convicting him of possession of drug paraphernalia in violation of N.D.C.C. §§ 19-03.4-03 and 19.1-03.1-07(5). Parizek argues the district court failed to give him a complete transcript to prepare his appeal. He also argues that the district court did not properly question him to determine whether his guilty plea was voluntary and that he had ineffective assistance of counsel. The judgment of conviction is affirmed under N.D.R.App.P. 35.1(a)(4). We summarily affirm without prejudice to Parizek's right to raise the issue of ineffective assistance of counsel in post-conviction proceedings. See State v. Palmer, 2002 ND 5, ¶ 13, 638 N.W.2d 18.
