STATE OF LOUISIANA v. DEREK O'KEEFE

In Re: Derek O'Keefe, applying for supervisory writs, 22nd Judicial District Court, Parish of St. Tammany, No. 523564. BEFORE: GUIDRY, THERIOT, AND DRAKE, JJ.

WRIT DENIED.

MRT

EGD

Guidry, J., dissents in part and would grant the writ application in part. Relator alleges that he only pled guilty based on the representation that he would be eligible for parole consideration after serving two years of his sentence. Accordingly, I would remand the matter for an evidentiary hearing to determine if relator pled guilty because of a justifiable belief that he was going to be eligible for parole consideration after serving two years of his sentence.
