State v. Nikeemia Coucil

The Court of Appeals of Washington, Division One
Dec 24, 2007
142 Wn. App. 1015 (Wash. Ct. App. 2007)

Opinion

No. 59694-2-I.

December 24, 2007.

Appeal from a judgment of the Superior Court for King County, No. 06-1-10843-1, Andrea A. Darvis, J., entered March 5, 2007.

Affirmed by unpublished opinion per Appelwick, C.J., concurred in by Coleman and Agid, JJ.

Nikeemia Coucil appeals his conviction for felony harassment, arguing that the information was deficient for failing to include an essential element, i.e. that the threat to kill was a "true threat." This argument is controlled by our recent decision in State v. Tellez, No. 58155-4-I, 2007 WL 3133865 (Wash.Ct.App. Oct. 29, 2007) ("true threat" requirement is not an element and need not be included in the information).

Affirmed.
