DECISION AND ORDER ON MOTION

Motion to approve a judicial stipulation.

Upon the papers filed in support of the motion and the papers filed in response thereto, it is

ORDERED that the motion is granted, without costs, only to the extent that the appeal taken by notice of appeal dated April 11, 2011 is removed from the April 2012 term of this Court, said appeal is consolidated with the appeal taken by notice of appeal dated February 3, 2012 to the extent that the appeals shall be heard together, appellant shall file and serve a brief and a supplemental record on appeal on or before May 7, 2012 and the time to file and serve a responding brief to the appeals is extended to June 21, 2012.
