STATE OF LOUISIANA v. ROY MORGAN


In Re: Roy Morgan, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 10-81-0785. BEFORE: WHIPPLE, C.J., GUIDRY AND McCLENDON, JJ.

WRIT GRANTED. This matter is granted for the sole purpose of remanding to the district court to conduct a hearing on the merits of relator's DNA request and to make a specific determination as to whether the specified items of evidence susceptible to DNA testing still exist. See State ex rel. Randolph v. State, 2002-1372 (La. 5/9/03), 847 So.2d 1183 [per curiam).
