On Defendant's Motion for Postconviction Relief. Stayed.
ORDER
This 7th day of November, 2001, upon review of Defendant's Motion for Postconviction Relief and the record in this case, it appears that:
On July 31, 2001, Defendant, Thomas L. Moore, filed a Motion for Postconviction Relief pursuant to Rule 61, seeking relief from a conviction for violating the terms of his probation in the above-captioned proceedings. The Court determined that Defendant's motion was moot. See State v. Moore, Super. Ct., Cr. A. No. IN99-02-1545 (Aug. 27, 2001) (ORDER). On September 26, 2001, Defendant filed an appeal with the Supreme Court, which is currently pending before that Court. Defendant filed this motion on October 24, 2001.
Therefore, the Court will STAY Defendant's Motion for Postconviction Relief pending the Supreme Court's decision in Defendant's appeal.
