NO. 2015 CW 0492
01-22-2016
In Re: Unisys Corporation, Molina Healthcare, Inc., and Molina Information Systems, LLC d/b/a Molina Medicaid Solutions, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 631612. BEFORE: GUIDRY, McDONALD, McCLENDON, THERIOT, AND CHUTZ, JJ.
WRIT GRANTED. The facts alleged in the State's petition, even if proven true, would not support a remedy under either the Medical Assistance Programs Integrity Law (MAPIL), La. R.S. 46:437.1 et seq., or the Louisiana Unfair Trade Practices Act (LUTPA), La. R.S. 55:1401 et seq. Therefore, the trial court's March 12, 2015 judgment denying defendants-relators' exceptions of no cause of action as to those claims is reversed, and judgment is entered in their favor, sustaining the exceptions of no cause of action and dismissing those specific claims.
