STATE OF LOUISIANA v. JOSEPH D. MIXON


In Re: Joseph D. Mixon, applying for supervisory writs, 21st Judicial District Court, Parish of Livingston, No. 26005. BEFORE: HIGGINBOTHAM, THERIOT AND CHUTZ, JJ.

WRIT GRANTED. Relator's writ application is remanded to the district court for consideration of the merits of his motion to correct an illegal sentence. Relator has included a sentencing transcript indicating his sentence was imposed without benefit of parole. However, La. R.S. 14:31(B) does not restrict parole eligibility.
