Supreme Court of Florida
Sep 28, 1978
363 So. 2d 796 (Fla. 1978)

Opinion

No. 53722.

September 28, 1978.

Appeal from Circuit Court, Dade County; Natalie Baskin, Judge.

Robert L. Shevin, Atty. Gen., and Calvin L. Fox, Asst. Atty. Gen., Miami, and Janet Reno, State's Atty., and Dennis L. Curran, Asst. State's Atty., Miami, for appellant.

Bennett H. Brummer, Public Defender, Miami, for appellee.

The order of the trial court, granting the motion to dismiss on the ground that Section 812.014, Florida Statutes (1977), is unconstitutional, is reversed. See State v. Allen, 362 So.2d 10 (Fla. 1978). This case is remanded to the trial court for proceedings consistent with that decision.

It is so ordered.

ENGLAND, C.J., and ADKINS, BOYD, OVERTON, SUNDBERG, HATCHETT and ALDERMAN, JJ., concur.
