STATE OF MAINE v. MICHAEL MCCONNELL


DEFAULT JUDGMENT ORDER

On July 3, 2023, this matter was set for dispositional conference. MICHAEL MCCONNELL failed to appear for court on that date, which resulted in a default judgment being entered against him.

It is hereby ordered that a $250 fine be imposed on each charge of the complaint, which is the minimum mandatory fine that can be imposed for this offense, and restitution in the amount of $1,372.74. It is also ordered that, pursuant to 7 M.R.S. § 3952-A (2), MCCONNELL, the owner of Cujo and Flint, comply with the following conditions:

• The dogs must be securely muzzled with a basket-style muzzle, restrained by a leash not more than 3 feet in length with a minimum tensile strength of 300 pounds and be under the direct control of the dogs owner or keeper, whenever the dog is off of the owner's premises;
• The owner must obtain a minimum of $100,000 in liability insurance for the life of the dogs;
• The dogs must be immediately registered with the Town of Lubec as dangerous dogs.
