State of Vermont v. Zachariah A. McAllister

ENTRY ORDER APPEALED FROM: Superior Court, Windham Unit, Criminal Division DOCKET NO. 1379-12-17 Wmcr Trial Judge: Michael R. Kainen

In the above-entitled cause, the Clerk will enter:

Defendant Zachariah McAllister appeals the trial court's decision holding him without bail pursuant to 13 V.S.A. § 7553. The State conceded at oral argument that there is insufficient admissible evidence for the State to establish the evidence of guilt is great under § 7553. Accordingly, the hold-without-bail order is reversed and the case is remanded for further proceedings consistent with this opinion.

Reversed and remanded.
