STATE of New Jersey, Plaintiff-Respondent, v. Nixon MARQUEZ, Defendant-Movant.


ORDER

This matter having been opened to the Court on Defendant's motion for leave to appeal seeking review of the trial court order of June 9, 2023, granting pretrial detention, and the Court having reviewed the briefs submitted by Defendant and the State, and the Court having determined that a remand to the trial court is required; it is

ORDERED that the matter is remanded to the trial court for a statement of reasons. The trial court shall submit the statement to the Court on or before October 24, 2023; and it is further

ORDERED that the parties may file supplemental briefs with the Court on the motion for leave to appeal addressing the trial court's statement on the following schedule: Defendant may serve and file a supplemental brief within 10 days of the trial court's submission to the Court, or by November 3, 2023, whichever occurs first, and the State may file a supplemental brief in response within 10 days of Defendant's supplemental submission, or by November 13, 2023, whichever occurs first.

In providing for the submission of a statement of reasons, the Court takes no position on the merits of the decision, and defendant's challenge remains pending. Jurisdiction is retained.
