ORDER GRANTING STIPULATION FOR DISMISSAL OF APPEAL

Upon consideration of the Stipulation for Dismissal of Appeal filed on May 29, 2008 and signed by counsel for Defendant-Appellant Tierron Madden, Jr. (Appellant) and the State of Hawai'i, the papers in support, and the records and files herein, it appears that the Stipulation for Dismissal of Appeal is supported by Appellant's declaration indicating he understands the consequences of dismissing the appeal and that withdrawal of the appeal is voluntary. Therefore,

IT IS HEREBY ORDERED that the Stipulation for Dismissal of Appeal is approved, and this appeal is dismissed.
