STATE OF LOUISIANA v. WILLIAM WAYNE LEE, JR.


In Re: William Wayne Lee, Jr., applying for supervisory writs, 22nd Judicial District Court, Parish of St. Tammany, No. 370,993. BEFORE: GUIDRY, PETTIGREW AND GRAIN, JJ.

WRIT GRANTED. The district court's ruling denying relator's "motion to preserve evidence pending appellate review" is reversed and the motion is granted. As the state has no objections to the preservation of the evidence in this case, we see no harm in preserving the evidence until relator has exhausted his supervisory review of the denial of his application for postconviction relief.
