Opinion
NO. 2018 KW 1247
09-11-2018
In Re: Thomas Lee, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 05-18-0716. BEFORE: PETTIGREW, WELCH, AND CHUTZ, JJ.
WRIT NOT CONSIDERED. The defendant failed to comply with Uniform Rules of Louisiana Courts of Appeal, Rule 4-5(A) & (B), in that the application does not contain an affidavit verifying the allegations of the application, nor are the pages numbered consecutively. Moreover, although it is not a violation of the Uniform Rules, we note that the defendant failed to include a copy of the July 20, 2018 hearing transcript on the defendant's original motion to reduce bond and other relevant documents used at the defendant's initial appearance. See City of Baton Rouge v. Plain, 433 So.2d 710 (La.), cert. denied, 464 U.S. 896, 104 S.Ct. 246, 78 L.Ed.2d 235 (1983). Furthermore, supplementation of this writ application and/or an application for rehearing will not be considered. See Uniform Rules of Louisiana Courts of Appeal, Rules 2-18.7 & 4-9. In the event the defendant elects to file a new application with this court, the application shall be filed on or before September 25, 2018 and should include the entire contents of this application, the missing items, and a copy of this ruling.
