ORDER

This 16th day of August, 2012, upon consideration of Defendant's Motion for Postconviction Relief, the Commissioner's Report and Recommendation and the record in this case:

1) The Court referred this Motion to Superior Court Commissioner Michael Reynolds pursuant to 10 Del. C. §512(b) and Superior Court Rule 62 for proposed findings of facts and conclusions of law.

2) The Commissioner has filed a Report and Recommendation that the Court deny Defendant's Motion for Postconviction Relief.

3) Defendant filed an Appeal from the Commissioner's findings on August 1, 2012.

NOW THEREFORE, after careful and de novo review of the record in this action, and consideration of defendant's response to the Commissioner's Report, and for reasons stated in the Commissioner's Report and Recommendations of July 11, 2012,

IT IS ORDERED that the Commissioner's Report, including its recommendation, is adopted by the Court. Defendant's Motion for Postconviction Relief is DENIED.

IT IS SO ORDERED.
