State v. Kelley

District Court of Appeal of Florida, Second District
May 27, 1981
399 So. 2d 81 (Fla. Dist. Ct. App. 1981)

Opinion

No. 80-2214.

May 27, 1981.

Appeal from nonfinal order from the Circuit Court, Pinellas County; Robert E. Beach, Judge.

Jim Smith, Atty. Gen., Tallahassee, and Charles Corces, Jr., Asst. Atty. Gen., Tampa, for appellant.

Jerry Hill, Public Defender, Bartow, and Allyn Giambalvo, Asst. Public Defender, St. Petersburg, for appellee.

We affirm the granting of the motion to suppress the evidence seized at the scene of the arrest of the defendant. Any implication that the defendant could not be prosecuted by reason of the granting of the "motion to suppress the person of the defendant" is unwarranted.

HOBSON, Acting C.J., and GRIMES and CAMPBELL, JJ., concur.
