       PER CURIAM.

       Only the Clerk's transcript is before this court, brought here by a notice of appeal signed by Willard F. Russell, Special County Attorney of Tama County. While the statute authorizes the State to appeal in such instances, Section 793.20, Code 1954, I.C.A., only legal questions that may be of benefit to the Bench and Bar will be considered. State v. Hill, 244 Iowa 405, 57 N.W.2d 58. It may be such legal issues arose on the trial of this case and if so, appeal being deemed essential, it was the duty of the State to direct the same to the attention of this Court. It did not do so.

       Affirmed.
