STATE OF LOUISIANA v. DERRICK JOHNSON


In Re: Derrick Johnson, applying for supervisory writs, 32nd Judicial District Court, Parish of Terrebonne, No. 483, 407.

BEFORE: KUHN, HIGGINBOTHAM, AND THERIOT, JJ.

WRIT DENIED. Relator's conviction was final on October 3, 2008, as he failed to timely seek review of this Court's decision with the Louisiana Supreme Court. See State v. Johnson, 2008-2656 (La. 5/22/09), 9 So.3d 132. The judgment rendered by this Court became final when the delay for filing for a rehearing expired and no application for rehearing was made. See La. Code Crim. P. art. 922(B); Uniform Rules of Louisiana Courts of Appeal, Rule 2-18.2(A). Thus, relator's application for postconviction relief was filed untimely. See State v. Dixon, 2010-1905 (La. 3/25/11), 61 So.3d 648.
